Possible judicial ethics violation in 9th Circuit Recall Case

I have to say I completely agree with Bill Dyer's post about Judge Pregerson, the federal appeals court judge who sat on the panel that rendered the recent decision postponing the California Recall Election. A judge should not comment on a pending case (see Bill Dyer's post) and it looks like Judge Pregerson has violated that Judicial Canon. Howard Bashman agrees, and actually was the first one to bring this up. So does Eugene Volokh. I wonder if appropriate action will be taken?
